淺論環(huán)境法的調(diào)整對(duì)象

摘要
環(huán)境法的調(diào)整對(duì)象是否獨(dú)立而有特色，不僅是環(huán)境法律部門(mén)存在的基礎(chǔ)，也是環(huán)境法學(xué)與其他法律科學(xué)聯(lián)系，區(qū)分開(kāi)來(lái)的主要方面，更體現(xiàn)了環(huán)境法的本質(zhì)特點(diǎn)和規(guī)律。總的來(lái)說(shuō)，它是環(huán)境法理論基礎(chǔ)中頗具特色的一部分,關(guān)于調(diào)整人與自然關(guān)系的環(huán)境法學(xué)理論，則是對(duì)環(huán)境法的長(zhǎng)遠(yuǎn)發(fā)展、總體發(fā)展起指導(dǎo)作用的理論，是將環(huán)境道德與環(huán)境法制建設(shè)結(jié)合起來(lái)以實(shí)現(xiàn)環(huán)境法治的理論。

THE ADJUSTING TARGET OF ENVIRONMENT PROTECTING LAW
ABSTRACT
The adjusting target’s independence and characteristic of Environment protecting law are not only the foundation of environmental law’s exists, but also the main aspect contacted scientifically between environmental law science and other laws, the main aspect distinguished, and has reflected the essential characteristics and rules of the environmental law even more. Generally speaking, it has much a characteristic part in the theoretical foundation of the environmental law. The environmental law’s science theory in adjusting the relation between people and natural is dedicated to environmental long-term and overall development, which playing a guiding role of law, combining the environmental morals and environmental legal construction together in order to realize the environment governed by law.
